Kutanisha Platform Terms & Conditions

By accessing or using Kutanisha, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions in full. If you do not agree to these Terms, you must immediately discontinue use of the platform. These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

1. Worker Terms (Casual Workers)

1.1 Independent Status

Workers registered on Kutanisha operate as independent freelancers. Nothing contained on the platform shall create an employer–employee relationship between Kutanisha and any worker. Kutanisha shall not be responsible for salaries, statutory deductions, pension contributions, NHIF, NSSF, PAYE, or employee benefits.

1.2 No Guarantee of Employment

Kutanisha does not guarantee employment opportunities, income, or availability of work. Opportunities are dependent on employer demand and market conditions.

1.3 Payment

All payments shall be negotiated and settled directly between employers and workers through cash or M-Pesa. Kutanisha shall not be liable for unpaid wages, delayed payments, or payment disputes.

1.4 Accuracy of Information

Workers shall provide truthful, accurate, and complete information regarding their identity, skills, experience, rates, and location. Any misrepresentation may result in suspension or permanent termination of the account.

1.5 Identity Verification

All workers must upload a valid Kenyan National ID card for verification purposes. Submission of fraudulent documents shall result in immediate account termination and possible reporting to law enforcement authorities.

1.6 Worker Safety

Workers are advised not to disclose confidential financial information, including M-Pesa PINs or banking credentials. Workers should only engage with employers formally introduced through Kutanisha and are encouraged to report suspicious or unsafe conduct immediately.

1.7 Conduct

Workers shall conduct themselves professionally and lawfully. Harassment, fraud, theft, violence, discrimination, or unlawful conduct shall result in permanent removal from the platform and may be reported to the relevant authorities.

1.8 Success-Based Charge

Casual workers: KES 500 per successful placement, payable to Kutanisha immediately upon conclusion of the engagement.

2. Employer Terms (Hiring a Worker)

2.1 No Agency Relationship

Kutanisha acts solely as an intermediary platform and does not guarantee the competence, suitability, qualifications, or character of any worker.

2.2 Hiring Request Fee

Employers shall pay a non-refundable request fee of KES 100 for each hiring request submitted through the platform.

2.3 Direct Payment

Employers shall pay workers directly. Kutanisha does not hold salaries, wages, deposits, or commissions from worker payments.

2.4 Indemnity

Employers agree to indemnify and hold harmless Kutanisha against all claims, losses, liabilities, damages, or disputes arising from engagement with workers.

2.5 Respectful Treatment

Employers shall treat all workers with dignity and respect. Harassment, abuse, exploitation, or unlawful conduct shall result in permanent account suspension and possible legal action.

2.6 Prohibited Conduct

Employers shall not recruit workers for illegal activities or unlawful purposes.

2.7 Success-Based Charge

Employers: KES 1,000 per successful hire, payable to Kutanisha immediately upon conclusion of the engagement.

3. Declutter Marketplace — Seller Terms

3.1 Platform Role

Kutanisha operates solely as a digital listing platform and does not inspect, store, verify, or ship listed items.

3.2 Listing Fee

A non-refundable listing fee of KES 100 shall apply to every marketplace listing.

3.3 Verification

All sellers must submit a valid Kenyan National ID for identity verification purposes.

3.4 Prohibited Items

The following items are prohibited: stolen property; counterfeit or pirated goods; firearms and dangerous weapons; illegal narcotics and regulated substances; wildlife products prohibited under Kenyan law.

3.5 Accuracy of Listings

Sellers shall provide accurate descriptions, pricing, and original photographs of listed items.

3.6 Safety Precautions

Users are encouraged to meet in safe public locations and verify M-Pesa payment confirmations before releasing items.

3.7 Termination

Kutanisha reserves the right to remove listings and terminate accounts involved in fraud, abuse, or unlawful conduct.

3.8 Success-Based Charge

Declutter sellers: 10% of product price per completed sale, payable to Kutanisha immediately upon conclusion of the transaction.

4. Declutter Marketplace — Buyer Terms

4.1 As-Is Transactions

All items are sold on an "as-is, where-is" basis without warranties or guarantees.

4.2 No Buyer Protection

Kutanisha does not process payments and shall not be liable for failed or fraudulent transactions.

4.3 Duty of Inspection

Buyers are responsible for independently inspecting and verifying listed items before purchase.

4.4 Safety Rules

Buyers should meet sellers only in secure public locations and avoid advance payments prior to inspection.

4.5 Compliance with Law

Buyers are advised that handling stolen goods constitutes an offense under Kenyan law.

4.6 Success-Based Charge

Declutter purchasers: KES 1,000 per completed purchase, payable to Kutanisha immediately upon conclusion of the transaction.

5. Property Listing — Seller / Lister Terms

5.1 Platform Status

Kutanisha is not a licensed real estate agency, broker, or auctioneer.

5.2 Listing Fee

All property listings require payment of a non-refundable validation fee of KES 100.

5.3 Proof of Ownership

Users may only list property they legally own or are authorized to market.

5.4 Fraudulent Listings

Fraudulent listings may result in account suspension and reporting to the Directorate of Criminal Investigations (DCI).

5.5 Listing Accuracy

All property descriptions, pricing, and photographs must accurately reflect the property being advertised.

5.6 Success-Based Charge

Property sellers / listers: 10% of property price per completed sale or letting, payable to Kutanisha immediately upon conclusion of the transaction.

6. Property — Buyer / Tenant Terms

6.1 Directory Service

Kutanisha serves solely as a property listing directory and does not guarantee ownership, legality, or property condition.

6.2 No Financial Responsibility

Kutanisha shall not be liable for deposits, rental payments, or financial losses resulting from transactions conducted through the platform.

6.3 Due Diligence

Buyers and tenants are advised to conduct official land searches, physical inspections, and engage qualified legal counsel before completing transactions.

6.4 Rental Safety

Users are strongly advised against paying deposits or booking fees before physically inspecting a property and signing a tenancy agreement.

6.5 Success-Based Charge

Property finders / buyers: KES 1,000 per completed match, payable to Kutanisha immediately upon conclusion of the transaction.

All success-based charges shall be paid to the Kutanisha till number immediately upon conclusion of the transaction. Failure to remit these charges may result in account suspension and recovery action under the laws of Kenya.

7. Privacy Policy

7.1 Data Collection

Kutanisha may collect personal information including names, phone numbers, location data, National ID documentation, IP addresses, and listing information.

7.2 Use of Data

Collected data shall be used for account verification, platform operations, matching services, communication, fraud prevention, and dispute resolution.

7.3 Data Sharing

Kutanisha shall not sell or rent personal data to third parties for marketing purposes. Data may only be shared where required by law or necessary to facilitate platform services.

7.4 Data Security

Kutanisha shall implement reasonable technical and organizational measures to safeguard user data.

7.5 User Rights

Users may request access to, correction of, or deletion of personal information by contacting admin@kutanisha.com.

8. General Provisions

8.1 Governing Law

These Terms & Conditions shall be governed by the laws of the Republic of Kenya.

8.2 Dispute Resolution

Parties shall first seek amicable resolution of disputes. Any unresolved disputes shall be subject to the jurisdiction of Kenyan courts.

8.3 Amendments

Kutanisha reserves the right to amend these Terms & Conditions at any time. Continued use of the platform following amendments constitutes acceptance of the revised Terms.

8.4 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
